DPE GOUGE TERMS & CONDITIONS

OVERVIEW

These Terms & Conditions ("Terms") govern the submission, purchase, trading, and use of Designated Pilot Examiner (DPE) checkride experience reports ("Gouges") on the Postflyte platform. By participating in our Gouge marketplace, you agree to these Terms in addition to our general Terms of Service.

1. DEFINITIONS

• "Gouge": A checkride experience report detailing a user's experience with a specific DPE

• "Submitter": A user who creates and submits a Gouge

• "Purchaser": A user who buys or trades for a Gouge

• "Trade Credit": Credit earned by submitting a Gouge, redeemable for another Gouge

2. CONTENT STANDARDS

2.1 Acceptable Gouge Content

Gouges MUST contain:

• Date of checkride (month/year)

• DPE name and location

• Certificate/rating tested

• General areas of emphasis

• Overall experience and tips

• Approximate duration

• Study recommendations

2.2 Prohibited Content

Gouges MUST NOT contain:

• Verbatim test questions from FAA knowledge tests

• Content that violates FAA test integrity policies

• False or misleading information

• Defamatory statements about DPEs

• Profanity or inappropriate content

• Personal attacks or discrimination

• Proprietary training materials

2.3 Accuracy Requirements

• All information must be based on actual personal experience

• Submitters must have taken the checkride described

• Information must be reasonably current (within 2 years)

• Any unusual circumstances must be disclosed

3. SUBMISSION GUIDELINES

3.1 Eligibility to Submit

To submit a Gouge, you must:

• Have personally taken the checkride described

• Be the original author of the content

• Have the right to share the information

• Not be bound by any conflicting agreements

3.2 Submission Process

Complete all required fields in the submission form

Review content for accuracy and completeness

Acknowledge ownership and accuracy

Submit for review

3.3 Review Process

• All Gouges are reviewed for compliance with these Terms

• Review typically completed within 48 hours

• We may request clarifications or edits

• We reserve the right to reject non-compliant submissions

4. OWNERSHIP & LICENSING

4.1 Intellectual Property Assignment

By submitting a Gouge, you:

• Assign all rights, title, and interest in the Gouge to Postflyte

• Waive any moral rights in the content

• Grant Postflyte unlimited right to use, modify, and distribute the Gouge

• Acknowledge this is a work-for-hire arrangement

4.2 Submitter Representations

You represent and warrant that:

• You are the original author

• The content is accurate to the best of your knowledge

• You have the right to assign ownership

• The content doesn't infringe any third-party rights

• You haven't been compensated by the DPE for the review

5. PRICING & PAYMENT

5.1 Purchase Price

• Individual Gouge purchase: $12.00 USD

• Prices subject to change with notice

• All sales are final

5.2 Trade System

• Submit one approved Gouge = Receive one Trade Credit

• Trade Credits valid for 1 year from issuance

• Trade Credits are non-transferable

• Cannot combine Trade Credits with monetary payment

5.3 Payment Processing

• Payments processed by secure third-party providers

• Accepted methods: Credit/debit cards, PayPal

• You're responsible for applicable taxes

• Receipts provided via email

6. REFUND POLICY

6.1 No Refunds

All Gouge sales are FINAL. No refunds will be issued for:

• Change of mind

• Checkride already taken

• Disagreement with content

• DPE availability changes

• Unsuccessful checkrides

6.2 Limited Exceptions

Refunds may be considered only for:

• Technical errors preventing access

• Duplicate purchases (same Gouge)

• Fraudulent content (upon investigation)

7. USAGE RIGHTS & RESTRICTIONS

7.1 Permitted Use

Purchasers may:

• View and study the Gouge for personal use

• Print one copy for personal study

• Use information to prepare for checkrides

7.2 Prohibited Use

Purchasers may NOT:

• Share, distribute, or resell Gouges - reselling is strictly prohibited

• Post Gouge content on other platforms

• Create derivative works

• Use for commercial purposes

• Share login credentials

• Screenshot and share Gouge content

7.3 Enforcement

Violations may result in:

• Account termination

• Forfeiture of Trade Credits

• Legal action for damages

8. DISCLAIMERS

8.1 Accuracy Disclaimer

IMPORTANT:

• Gouges reflect individual experiences only

• DPE testing may vary significantly

• Information may become outdated

• We don't verify all details

• Checkride success is NOT guaranteed

8.2 No Professional Advice

Gouges are NOT:

• Professional flight instruction

• Official FAA guidance

• Guaranteed study material

• Comprehensive test preparation

• Legal or regulatory advice

8.3 FAA Compliance

• All checkrides must comply with current FARs

• Practical Test Standards/ACS requirements may change

• You must study all official FAA materials

• Gouges supplement but don't replace official prep

9. LIABILITY LIMITATIONS

9.1 No Guarantee of Results

Postflyte makes NO guarantee regarding:

• Checkride success or failure

• Accuracy of Gouge content

• DPE testing consistency

• Continued DPE availability

9.2 Limitation of Liability

Our liability for any Gouge-related claim is limited to the purchase price ($12.00).

9.3 User Responsibility

You acknowledge that:

• Checkride preparation is your sole responsibility

• Official FAA materials are primary sources

• Gouges are supplementary only

• Success depends on your knowledge and skills

10. PRIVACY & CONFIDENTIALITY

10.1 Submitter Privacy

• Submitter names are NOT displayed on Gouges

• Submission tracked internally only

• Purchase history kept confidential

10.2 DPE Information

• DPE names and locations are public information

• We don't share DPE contact information

• Gouges reflect user opinions only

11. MODIFICATIONS TO TERMS

We may modify these Terms at any time. Continued use constitutes acceptance of modified Terms.

12. DISPUTE RESOLUTION

Any disputes related to Gouges will be resolved according to the dispute resolution provisions in our general Terms of Service.
